They aren't providing play-by-play or descriptions of the game, and they're not making any money by selling advertising, they're just offering opinion. Those of us listening to this commentary would still have to be watching the game ourselves, either on TV or via one of the live gamecast sites, to really have any idea of what is going on. IANAL, and it wouldn't surprise me if MLB found something to get upset about, but I don't see how that is any different from the live blogging of the game that happens here every game thread.
